Court Ruling Forbids Blocking of Easement Roads

The GMPOA joined with a group of landowners near the junction of Hoover Creek and Twin Peaks Roads to successfully challenge property owner Zack Singleton’s blocking of Twin Peaks Road. On April 24, 2018, Judge Ray Dayton in Deer Lodge found that all roads in the GMPOA (originally called OS Properties) since 1974 are easement roads with “unrestricted access” for property owners, their guests, and the public. No one may interfere with free passage on the roads, including locked gates, fencing, cables or other barriers. Any property owner who believes his or her easement road access has been illegally blocked should contact the Powell County Sheriff who is authorized to remove any impediment to free passage.
